BRECKENRIDGE, Colo. — A Colorado man who claimed he was trying to defend himself from a mugger when he shot himself in the groin has been convicted of illegal discharge of a firearm. Investigators said there was no evidence to substantiate David Leroy Blurton's self-defense claim and jurors convicted the 50-year-old on Wednesday. The shooting happened at the parking lot of a grocery store in Dillon, Colo., on May 2009. Prosecutors say Blurton had been drinking.

Jurors also convicted Blurton of "prohibited use of a weapon - drunk with a gun" and reckless endangerment. Prosecutors said they will request that Blurton be sentenced to probation.

Blurton maintained that someone hit him in the back of the head and he was trying to defend himself. :p :p

In the 1970's, the common goal of every pothead, and loser who couldn't hold a job, .. was to move to Colorado.

Most of them eventually crawled back home, and took up their predestined occupations, ... as landscapers, janitors, and career politicians.

But a disproportionately large number of them, remained in Colorado, ... and currently account for the chaos and lunacy that has become the norm in that State.


The fact that a drunk accidentally shot himself, ... is immaterial.

The fact that they would prosecute a self-inflicted gunshot victim, ... speaks volumes about the irrational fear of firearms.

wonder if they are prosecuting him for firearms or just being plane stupid...
i always thought that state was pretty conservative on that subject

I have no problem prosecuting a drunk with a gun who shoots himself. With privlege comes responsibility. Want to carry a gun, fine but have your wits about you when you do it.

But you've gotta' love the Poetic Justice, ... of "self-inflicted" punishment. :D

But here's the thing about "preemptive" law enforcement, that never feels quite right.

Apparently, Colorado has some sort of Statute about being "Drunk, with a Gun".

Now, I don't know how that particular Statute might be applied in routine practice, ... but I suspect that it's one of those "add on" charges, ( like making "terroristic threats" jjj ) that the DA's like to use, to "pad" every case they decide to prosecute.


But the point I'm trying to touch on, ... is that there's no special Statute about being "Drunk, with a Chain Saw", ... or "Drunk, with a Lawnmower", ... and being Drunk, and in possession of Car Keys is not against the Law .....

You have to actually commit the act of "DUI", before you can be prosecuted.

But apparently, ... just possessing a Gun, while "Drunk", ... is a crime ?


It's a very Slippery Slope, when you start trying to "protect" people, from hypothetical situations.


I'm of the opinion, that no Law can "foresee" all the situations that might potentially occur.


And the only thing we know for sure, about these sort of "preventative" measures, ... is that EVERYONE'S RIGHTS ARE SACRIFICED, with no guarantee that any actual benefit has been achieved.

Any disingenuous fool, with a hidden agenda, ... can dream up some lame-assed "what if this happens" scenario, ... to support yet another Law, that further compromises our Freedom.


The proponents of the Nanny State, need desperately to grow up, ... and realize that they can't "fix" everything, with endless Legislation.


We need to punish miscreants for the things that they actually DO, ... and stop punishing everyone, for things that MIGHT happen .....
